According to the principles of modern criminal procedure, a fair courtroom should have both parties present, follow the practice of “listening to the five aspects,” where the prosecution with public authority and the defendant supported by a defense lawyer compete equally. They strive to convince the judge and jury with facts and evidence, combined with solid logic and argumentation. Judges and juries, as the arbiters, must remain impartial. A loss of this neutrality equates to the black whistle in football, rendering the match devoid of fair play.<\/p>\n\n\n\n

\u53ef\u662f\uff0c\u6211\u548c\u738b\u6625\u4e3d\u6559\u6388\u4ee3\u7406\u7684\u9e70\u6f6d\u5434\u654f\u6848\uff0c\u5728\u529e\u6848\u673a\u5173\u6c5f\u897f\u7eaa\u59d4\u7684\u4e3b\u5bfc\u4e0b\uff0c\u9e70\u6f6d\u68c0\u6cd5\u4e24\u5bb6\u8fde\u5439\u9ed1\u54e8\u90fd\u5acc\u9ebb\u70e6\uff0c\u4ed6\u4eec\u4e00\u5f00\u59cb\u5c31\u4e0d\u7ed9\u6211\u548c\u738b\u6625\u4e3d\u4e0a\u573a\u7684\u673a\u4f1a\uff0c\u800c\u662f\u81ea\u884c\u4e3a\u6211\u65b9\u9009\u5b9a\u4e86\u4e0a\u573a\u7403\u5458\u3002 <\/p>\n\n\n\n

However, in the Yingtan Wu Min case, which Professor Wang Chunli and I are representing, under the direction of the Jiangxi Discipline Inspection Commission, Yingtan’s prosecutorial and judicial bodies didn’t even bother with the pretense of fairness. From the start, they denied Professor Wang Chunli and me the opportunity to participate, instead selecting the players for our side.<\/p>\n\n\n\n

\u5434\u654f\uff0c\u6c5f\u897f\u7701\u5409\u5b89\u5e02\u4eba\u5927\u5e38\u59d4\u4f1a\u539f\u515a\u7ec4\u4e66\u8bb0\u3001\u4e3b\u4efb\uff0c\u5148\u540e\u62c5\u4efb\u8fc7\u6cf0\u548c\u53bf\u53bf\u59d4\u4e66\u8bb0\uff0c\u4e95\u5188\u5c71\u5e02\u59d4\u4e66\u8bb0\uff0c\u5409\u5b89\u5e02\u5e38\u52a1\u526f\u5e02\u957f\u3002\u73b0\u5728\u7684\u5b98\u573a\uff0c\u5728\u8001\u767e\u59d3\u773c\u4e2d\uff0c\u6ca1\u4e00\u4e2a\u5e72\u51c0\u7684\u3002\u5434\u654f\u7adf\u80fd\u6210\u4e3a\u5c11\u6709\u7684\u4f8b\u5916\uff0c\u4ed6\u4ece\u653f\u51e0\u5341\u5e74\uff0c\u5b98\u58f0\u5f88\u597d\uff0c\u662f\u6709\u540d\u7684\u201c\u4e0d\u6536\u793c\u201d\u3002\u5982\u679c\u4e0d\u662f\u4e00\u573a\u53d8\u6545\uff0c\u4eca\u5e74\u7684\u6625\u8282\uff0c\u5434\u654f\u5e94\u8be5\u4f1a\u50cf\u5927\u591a\u6570\u7684\u666e\u901a\u8001\u4eba\u4e00\u6837\uff0c\u5728\u5bb6\u5e26\u7740\u5b59\u5b50\uff0c\u5b89\u4eab\u665a\u5e74\u3002 <\/p>\n\n\n\n

Wu Min, a former party group secretary and director of the People’s Congress Standing Committee in Ji’an City, Jiangxi Province, previously served as the county party secretary of Taihe County, the party secretary of Jinggangshan City, and the deputy mayor of Ji’an City. In today’s officialdom, seen through the eyes of the public, not a single clean official exists. Yet, Wu Min managed to be an exception. After decades in politics, he was well-regarded and known for “not accepting gifts.” If it hadn’t been for a twist of fate, he would have spent this Spring Festival like most ordinary elders, enjoying his later years at home with his grandchildren.<\/p>\n\n\n\n

\u5434\u654f\u6709\u4e00\u4e2a\u5f1f\u5f1f\u53eb\u5434\u5fe0\uff0c\u5728\u6c38\u4e30\u53bf\u5f00\u53d1\u623f\u5730\u4ea7\uff0c\u5434\u5fe0\u751f\u610f\u573a\u4e0a\u7684\u5408\u4f5c\u4f19\u4f34\u5218\u5168\u5168\uff0c\u56e0\u4e3a\u501f\u6c38\u4e30\u53bf\u7eaa\u59d4\u59d4\u5458\u6234\u8000\u9752\u7684\u4e24\u5343\u591a\u4e07\u9ad8\u5229\u8d37\u8fd8\u4e0d\u4e0a\uff0c\u6234\u8000\u9752\u5c31\u5e26\u7740\u9a6c\u4ed4\uff0c\u628a\u5434\u5fe0\u5173\u5728\u81ea\u5df1\u7684\u529e\u516c\u5ba4\u4e00\u8fde\u4e09\u5929\uff0c\u5176\u95f4\uff0c\u6234\u8000\u9752\u6beb\u4e0d\u63a9\u9970\u5176\u4eb2\u5bb6\u2014\u2014\u6c5f\u897f\u7eaa\u59d4\u515a\u59d4\u4e25\u6b63\u7684\u8eab\u4efd\uff0c\u660e\u786e\u544a\u8bc9\u5434\u5fe0\uff1a\u4f60\u4e0d\u66ff\u5218\u5168\u5168\u8fd8\u94b1\uff0c\u5c31\u8ba9\u7701\u7eaa\u59d4\u67e5\u4f60\u54e5\u5434\u654f\uff0c\u5f53\u5b98\u7684\u54ea\u6709\u67e5\u4e0d\u51fa\u4e8b\u7684\uff01 <\/p>\n\n\n\n

Wu Min has a brother named Wu Zhong, who was involved in real estate development in Yongfeng County. Wu Zhong’s business partner, Liu Quanquan, unable to repay a high-interest loan of over twenty million from Dai Yaoqing, a member of the Yongfeng County Discipline Inspection Commission, resulted in Dai, flaunting his in-law relationship with Yan Zheng of the Jiangxi Discipline Inspection Commission, detaining Wu Zhong in his office for three days. He explicitly threatened that if Wu Zhong didn\u2019t settle Liu\u2019s debt, the provincial commission would investigate his brother, Wu Min. It was implied that no official could escape scrutiny if investigated.<\/p>\n\n\n\n

\u5434\u5fe0\u4e3a\u4e86\u907f\u514d\u54e5\u54e5\u53d7\u7275\u8fde\uff0c\u4e00\u5ea6\u8868\u793a\u613f\u610f\u5e2e\u8fd8\u94b1\uff0c\u4f46\u662f\uff0c\u56e0\u4e3a\u501f\u94b1\u7684\u4e00\u65b9\u5218\u5168\u5168\u672c\u4eba\u62d2\u7edd\uff0c\u51e0\u65b9\u9762\u4eba\u9a6c\u6700\u7ec8\u6ca1\u6709\u8c08\u62e2\uff0c\u6234\u8000\u9752\u5c31\u75db\u4e0b\u6740\u624b\uff0c\u800c\u4e14\uff0c\u4ed6\u7684\u5a01\u80c1\u4e00\u4e00\u5151\u73b0\u4e86\u3002\u4e3a\u4e86\u6574\u5434\u654f\uff0c\u6c5f\u897f\u7eaa\u59d4\u6210\u7acb\u4e86\u4e0a\u767e\u4eba\u7684\u4e13\u6848\u7ec4\uff0c\u5148\u4e8e2022\u5e7412\u6708\u4ee5\u5f3a\u5b89\u7684\u4ecb\u7ecd\u5356\u6deb\u7f6a\uff0c\u7531\u6a1f\u6811\u53bf\u516c\u5b89\u5c40\u51fa\u4e86\u6307\u5b9a\u5c45\u6240\u76d1\u89c6\u5c45\u4f4f\u624b\u7eed\uff0c\u628a\u5434\u5fe0\u5173\u62bc\u5728\u6a1f\u6811\u7eaa\u59d4\u7684\u6240\u8c13\u5ec9\u653f\u6559\u80b2\u57fa\u5730\u3002\u516d\u4e2a\u6708\u540e\uff0c\u53c8\u8ba9\u5b89\u4e49\u53bf\u7eaa\u59d4\u4ee5\u884c\u8d3f\u7f6a\uff0c\u628a\u5434\u5fe0\u7559\u7f6e\u5728\u5b89\u4e49\u53bf\u5ec9\u653f\u57fa\u5730\u3002\u5176\u95f4\uff0c\u90fd\u662f\u6c5f\u897f\u7eaa\u59d4\u7684\u4e13\u6848\u7ec4\u4e00\u5929\u4e09\u73ed\uff0c\u5171\u5341\u516b\u4e2a\u5c0f\u65f6\u903c\u95ee\u5434\u5fe0\uff0c\u8ba9\u4ed6\u4ea4\u5f85\u54e5\u54e5\u5434\u654f\u7684\u95ee\u9898\u3002\u5434\u5fe0\u5bb6\u5c5e\u8bf7\u7684\u5f8b\u5e08\u8981\u6c42\u4f1a\u89c1\uff0c\u51fa\u5177\u6307\u5c45\u6240\u76d1\u89c6\u5c45\u4f4f\u624b\u7eed\u7684\u6a1f\u6811\u516c\u5b89\u5c40\u8bf4\uff1a\u8fd9\u662f\u7eaa\u59d4\u7684\u6848\u5b50\uff0c\u6211\u4eec\u7ba1\u4e0d\u4e86\u3002\u8f6c\u5230\u5b89\u4e49\u5ec9\u653f\u57fa\u5730\u540e\uff0c\u5c31\u66f4\u6ca1\u6709\u4e86\u5f8b\u5e08\u4f1a\u89c1\u7684\u673a\u4f1a\u3002 <\/p>\n\n\n\n

To avoid implicating his brother, Wu Zhong initially agreed to help repay the loan. However, since Liu himself refused, and negotiations with all parties involved failed, Dai resorted to threats, which he eventually carried out. To target Wu Min, the Jiangxi Discipline Inspection Commission assembled a task force of over a hundred people. In December 2022, accusing Wu Zhong of introducing prostitution, the Shangrao County Public Security Bureau issued a surveillance order, detaining him at what the Shangrao Discipline Inspection Commission called an “integrity education center.” Six months later, Anyi County’s commission detained him for bribery at their integrity center. Throughout, Jiangxi’s task force interrogated Wu Zhong in shifts, for eighteen hours a day, pressuring him to implicate his brother, Wu Min. When Wu Zhong\u2019s family hired a lawyer, the Shangrao Public Security Bureau, which had issued the surveillance order, claimed it was a case for the discipline inspection commission and thus out of their hands. After being transferred to the Anyi integrity center, there was no chance for lawyer visits. <\/p>\n\n\n\n

2023\u5e745\u670830\u65e5\uff0c\u6c5f\u897f\u7701\u7eaa\u59d4\u76d1\u59d4\u5bf9\u5434\u654f\u7559\u7f6e\uff0c5\u4e2a\u591a\u6708\u540e\u5c06\u5176\u4ece\u5ec9\u653f\u4e2d\u5fc3\u8f6c\u79fb\u81f3\u9e70\u6f6d\u5e02\u5f3a\u5236\u9694\u79bb\u6212\u6bd2\u6240\uff08\u9e70\u6f6d\u5e02\u4eba\u6c11\u533b\u9662\u76d1\u7ba1\u5206\u9662\uff09\u7f81\u62bc\uff0c\u540e\u79fb\u9001\u9e70\u6f6d\u5e02\u68c0\u5bdf\u9662\u8d77\u8bc9\uff0c\u68c0\u5bdf\u9662\u4e8e2023\u5e7412\u670822\u65e5\u4ee5\u5434\u654f\u6d89\u5acc\u53d7\u8d3f\u7f6a\uff0c\u8d77\u8bc9\u81f3\u9e70\u6f6d\u5e02\u4e2d\u7ea7\u6cd5\u9662\u3002\u4f46\u662f\u76f4\u52302024\u5e741\u670811\u65e5\uff0c\u6c5f\u897f\u7701\u7eaa\u76d1\u59d4\u624d\u5bf9\u5176\u5b98\u5ba3\u3002 <\/p>\n\n\n\n

On May 30, 2023, the Jiangxi Provincial Discipline Inspection Commission detained Wu Min, and after more than five months, transferred him from the integrity center to a compulsory isolation detox center in Yingtan (managed by Yingtan People\u2019s Hospital), later moving the case to the Yingtan Public Prosecutor’s Office. On December 22, 2023, the prosecutor charged him with bribery at the Yingtan Intermediate Court. However, it wasn\u2019t until January 11, 2024, that the Jiangxi Provincial Commission for Discipline Inspection officially announced the charges.<\/p>\n\n\n\n

2024\u67081\u670815\u65e5\uff0c\u738b\u6625\u4e3d\u5f8b\u5e08\u5e26\u7740\u5bb6\u5c5e\u7684\u59d4\u6258\uff0c\u5230\u9e70\u6f6d\u76d1\u7ba1\u533b\u9662\u4f1a\u89c1\u5434\u654f\uff0c\u76d1\u7ba1\u533b\u9662\u8bf4\uff1a\u8fd9\u662f\u7eaa\u59d4\u7684\u6848\u5b50\uff0c\u5f8b\u5e08\u4f1a\u89c1\uff0c\u5fc5\u987b\u7eaa\u59d4\u540c\u610f\u3002\u738b\u6625\u4e3d\u5f8b\u5e08\u8d28\u95ee\uff1a\u6848\u5b50\u90fd\u5230\u6cd5\u9662\u4e86\uff0c\u7eaa\u59d4\u6709\u4ec0\u4e48\u6743\u529b\u5e72\u9884\u5f8b\u5e08\u4f1a\u89c1\uff1f\u76d1\u7ba1\u533b\u9662\u7684\u4eba\u8bf4\u6211\u4eec\u53ea\u80fd\u542c\u7eaa\u59d4\u7684\u3002 <\/p>\n\n\n\n

On January 15, 2024, accompanied by the family’s authorization, Lawyer Wang Chunli visited Wu Min at the Yingtan detention center, which stated that for lawyer visits, the Discipline Inspection Commission’s approval was required. Lawyer Wang Chunli questioned: “The case is already in court, what right does the commission have to intervene in lawyer visits?” The detention center responded, “We can only follow the commission\u2019s orders.”<\/p>\n\n\n\n

\u5176\u5b9e\uff0c\u5c31\u5728\u8fd9\u65f6\uff0c\u5728\u6c5f\u897f\u7eaa\u59d4\u7684\u6307\u793a\u4e0b\uff0c\u9e70\u6f6d\u68c0\u6cd5\u548c\u53f8\u6cd5\u5c40\u5df2\u7ecf\u7ed9\u5434\u654f\u5b89\u6392\u4e00\u4e86\u4f4d\u6cd5\u5f8b\u63f4\u52a9\u5f8b\u5e08\uff0c\u5c31\u662f\u672c\u5730\u7684\u5434\u6587\u5146\u5f8b\u5e08\u3002\u5f53\u7740\u5bb6\u5c5e\u7684\u9762\uff0c\u5434\u6587\u5146\u975e\u5e38\u5766\u8bda\uff1a\u4f60\u4eec\u5bb6\u8fd9\u4e2a\u6848\u5b50\uff0c\u5c31\u662f\u6709\u4eba\u501f\u5200\u6740\u4eba\uff0c\u8fd9\u5c31\u662f\u4e2a\u653f\u6cbb\u6848\u5b50\uff0c\u4f60\u4eec\u4e0d\u5c31\u662f\u6d89\u53ca\u4e00\u5957\u623f\u5b50\uff0c\u8fd9\u53c8\u600e\u4e48\u6837\uff1f\u8584XX\u4e0d\u4e5f\u662f\u4e00\u5957\u623f\u5b50\uff1f\u4e00\u67e5\uff0c\u67e5\u51fa\u6765\u4e00\u4e2a\u6e05\u5b98\u3002\u8fd9\u53c8\u600e\u4e48\u6837\uff1f\u8fd9\u5c31\u662f\u653f\u6cbb\uff01XXX\u603b\u7406\u4e0d\u90fd\u6b7b\u4e86\u5417\uff1f\u4f60\u4eec\u8fd8\u6709\u4ec0\u4e48\u60f3\u4e0d\u5f00\u8fc7\u4e0d\u53bb\u7684\uff01 <\/p>\n\n\n\n

At this point, under directives from the Jiangxi Discipline Inspection Commission, Yingtan’s prosecutorial and judicial authorities had already arranged a legal aid lawyer for Wu Min, a local named Wu Wenzhao. In front of the family, Wu Wenzhao candidly stated: “Your case is essentially one of being targeted through others; it\u2019s a political case. Does it matter that it involves a house? Didn\u2019t Bo XX have a house too? Once investigated, a clean official was found. What of it? It\u2019s all politics! Hasn\u2019t Prime Minister XXX passed away? What more do you have to worry about?”<\/p>\n\n\n\n

\u5bf9\u4e8e\u5434\u6587\u5146\u5f8b\u5e08\u5927\u9006\u4e0d\u9053\u7684\u8a00\u8bba\uff0c\u5f20\u5e86\u65b9\u548c\u738b\u6625\u4e3d\u5f8b\u5e08\u4e8e2024\u5e741\u670818\u65e5\u5728\u7f51\u7edc\u4e0a\u8fdb\u884c\u4e86\u516c\u5f00\uff0c\u5e76\u4e3e\u62a5\u5230\u9e70\u6f6d\u4e2d\u9662\uff0c\u9e70\u6f6d\u4e2d\u9662\u4e3b\u5ba1\u5434\u654f\u6848\u7684\u527d\u5ba2\u526f\u9662\u957f\uff08\u5728\u5357\u4eac\u5927\u5b66\u8bfb\u5728\u804c\u6cd5\u5f8b\u7855\u58eb\u65f6\u7684\u6bd5\u4e1a\u8bba\u6587\u6284\u88ad\u738763%\uff09\u5218\u8d5b\u8fde\u884c\u52a8\u8fc5\u901f\uff0c\u7b2c\u4e8c\u5929\u5c31\u628a\u5434\u654f\u5bb6\u5c5e\u53eb\u5230\u6cd5\u9662\uff1a\u4f60\u4eec\u4e0d\u662f\u5bf9\u5434\u6587\u5146\u4e0d\u6ee1\u610f\u5417\uff1f\u6211\u4eec\u53c8\u7ed9\u5434\u654f\u5b89\u6392\u4e86\u65b0\u7684\u6cd5\u63f4\u5f8b\u5e08\uff0c\u4ed6\u53eb\u8bb8\u6625\u6797\uff0c\u4f60\u4eec\u548c\u8bb8\u5f8b\u5e08\u8054\u7cfb\u5427\uff01 <\/p>\n\n\n\n

Regarding Lawyer Wu Wenzhao\u2019s outrageous statements, Zhang Qingfang and Lawyer Wang Chunli publicly exposed him on the internet on January 18, 2024, and reported him to the Yingtan Intermediate Court. Liu Sailian, the deputy chief justice of the court handling Wu Min\u2019s case (who plagiarized 63% of her master\u2019s thesis at Nanjing University), acted swiftly. The next day, she summoned Wu Min\u2019s family to the court: “You were dissatisfied with Lawyer Wu Wenzhao? We’ve arranged a new legal aid lawyer for Wu Min, named Xu Chunlin. You can contact Lawyer Xu.<\/p>\n\n\n\n

“\u81f3\u6b64\uff0c\u9e70\u6f6d\u65b9\u9762\u6253\u6b7b\u4e5f\u8981\u7ed9\u5434\u654f\u5f3a\u884c\u5b89\u6392\u5360\u5751\u5f8b\u5e08\uff0c\u575a\u51b3\u4e0d\u8bb8\u5434\u654f\u5bb6\u5c5e\u59d4\u6258\u7684\u5f8b\u5e08\u6709\u4e0a\u573a\u673a\u4f1a\u7684\u7528\u5fc3\uff0c\u662d\u7136\u82e5\u63ed\u4e86\uff01\u8fd9\u4e0d\u662f\u6bd4\u9ed1\u54e8\u8fd8\u9ed1\u5417\uff1f\u5982\u679c\u5bb9\u5fcd\u8fd9\u79cd\u5b89\u6392\uff0c\u804c\u52a1\u72af\u7f6a\u6848\u4ef6\u4e2d\uff0c\u8fd8\u6709\u4e2d\u56fd\u5211\u8fa9\u5f8b\u5e08\u5b58\u5728\u7684\u7a7a\u95f4\u5417\uff1f <\/p>\n\n\n\n

Thus, Yingtan authorities were determined to forcibly assign a placeholder lawyer for Wu Min, blatantly denying the family-appointed lawyer any opportunity to participate. Their intentions were clear! Isn\u2019t this darker than match-fixing? If such arrangements are tolerated, is there any space left for criminal defense lawyers in China?<\/p>\n\n\n\n

In staunch opposition to Yingtan authorities inserting a placeholder lawyer for Wu Min, we organized a \u201cplaceholder defense\u201d essay contest before the Spring Festival. Within just eight days, we received 66 papers from lawyers and academics nationwide, thoroughly discussing the performance and harm of placeholder defense. We also submitted a compilation of these essays and a summary report to the relevant authorities, who expressed their support for the rights of the family\u2019s lawyer, yet until today, our request for meeting rights remains unanswered, even with the \u201cProcuratorate, Court, Justice, and Bar Association\u201d consultation mechanism in place in our great nation.<\/p>\n\n\n\n

\u5176\u95f4\uff0c\u6211\u4e5f\u7ed9\u66fe\u7ecf\u9ad8\u8c03\u8058\u8bf7\u4e86\u76d1\u7763\u5458\uff0c\u8981\u4fdd\u969c\u5f8b\u5e08\u4f1a\u89c1\u6743\u7684\u516c\u5b89\u90e8\u76d1\u7ba1\u5c40\u53d1\u53bb\u7ef4\u6743\u8bf7\u6c42\uff0c\u8981\u6c42\u4f1a\u89c1\u5434\u654f\uff0c\u5f53\u9762\u5f81\u6c42\u4ed6\u672c\u4eba\u7684\u610f\u89c1\uff1a\u4e3a\u4ec0\u4e48\u4e0d\u76f8\u4fe1\u5bb6\u5c5e\u8bf7\u7684\u5f8b\u5e08\uff0c\u4e3a\u4ec0\u4e48\u575a\u6301\u8981\u8ba9\u6240\u8c13\u7684\u7ec4\u7ec7\u4e0a\u5b89\u6392\u6cd5\u5f8b\u63f4\u52a9\u5f8b\u5e08\uff1f <\/p>\n\n\n\n

During this period, I also sent a rights protection request to the Public Security Bureau\u2019s supervision department, which had previously made a high-profile appointment of supervisors to guarantee lawyers’ rights to meet their clients. I requested a meeting with Wu Min to hear his personal opinion: Why doesn\u2019t he trust the lawyer hired by his family? Why insist on the so-called organizational arrangement of a legal aid lawyer?<\/p>\n\n\n\n

\u4f46\u662f\uff0c\u516c\u5b89\u90e8\u76d1\u7ba1\u5c40\u4e00\u542c\u662f\u6c5f\u897f\u7eaa\u59d4\u7684\u6848\u5b50\uff0c\u5c31\u8868\u793a\u8fd9\u4e8b\u4e0d\u597d\u529e\u3002 However, upon hearing it was a case from the Jiangxi Discipline Inspection Commission, the Public Security Bureau\u2019s supervision department indicated it was a difficult matter to handle.<\/p>\n\n\n\n

\u6625\u8282\u540e\u76842\u670823\u53f7\uff0c\u5434\u5fe0\u7684\u8fa9\u62a4\u4eba\u4f55\u667a\u5a1f\u5f8b\u5e08\u624b\u6301\u5434\u5fe0\u4eb2\u7b14\u4e66\u5199\u7684\u88ab\u6c5f\u897f\u7eaa\u59d4\u6b8b\u9177\u5730\u5211\u8baf\u903c\u4f9b\uff0c\u70ae\u5236\u51fa\u4eb2\u5f1f\u5f1f\u5411\u4eb2\u54e5\u54e5\u884c\u8d3f1190\u4e07\u7684\u60c5\u51b5\u8bf4\u660e\uff0c\u53bb\u9e70\u6f6d\u4e2d\u9662\u4ea4\u6d89\uff0c\u8d28\u95ee\u8fd9\u4e48\u4e00\u4e2a\u884c\u8d3f\u53d7\u8d3f\u7684\u6848\u5b50\uff0c\u4e3a\u4ec0\u4e48\u4e0d\u540c\u6848\u5ba1\uff0c\u4e3a\u4ec0\u4e48\u54e5\u54e5\u5434\u654f\u7684\u6848\u5b50\u5230\u6cd5\u9662\u4e86\uff0c\u5f1f\u5f1f\u5434\u5fe0\u8fd8\u5728\u4fa6\u67e5\u9636\u6bb5\uff0c\u8fd9\u4e0d\u662f\u6709\u610f\u5265\u593a\u4e24\u5144\u5f1f\u7684\u8fa9\u62a4\u6743\uff0c\u975e\u8981\u5728\u5bb6\u5c5e\u8bf7\u7684\u5f8b\u5e08\u4e0d\u5230\u5ead\u63a5\u89e6\u4e0d\u5230\u63a7\u65b9\u8bc1\u636e\u7684\u60c5\u51b5\u4e0b\uff0c\u5148\u628a\u5434\u654f\u6848\u9ed1\u7bb1\u64cd\u4f5c\u5f3a\u5224\u4e86\uff1f\u9762\u5bf9\u4f55\u667a\u5a1f\u5f8b\u5e08\u7684\u8d28\u95ee\uff0c\u9e70\u6f6d\u4e2d\u9662\u5305\u62ec\u5218\u8d5b\u8fde\u526f\u9662\u957f\u5728\u5185\u7684\u5408\u8bae\u5ead\u6210\u5458\u90fd\u4e0d\u6562\u51fa\u6765\u89c1\u9762\uff0c\u6700\u540e\u8ba9\u5211\u5ead\u7684\u674e\u6cd5\u5b98\u63a5\u5f85\u5e76\u63a5\u6536\u4e86\u6750\u6599\u3002\u4f46\u662f\uff0c\u65f6\u81f3\u4eca\u65e5\uff0c\u5bf9\u4f55\u667a\u5a1f\u5f8b\u5e08\u8981\u6c42\u5c06\u5434\u5fe0\u4e0e\u5434\u654f\u540c\u6848\u540c\u5ead\u5ba1\u7406\u7684\u8981\u6c42\uff0c\u9e70\u6f6d\u4e2d\u9662\u62d2\u4e0d\u7b54\u590d\u3002 <\/p>\n\n\n\n

After the Spring Festival, on February 23, Wu Zhong\u2019s lawyer, He Zhijuan, holding a statement personally written by Wu Zhong detailing his brutal interrogation and forced confession by the Jiangxi Discipline Inspection Commission, approached the Yingtan Intermediate Court. She questioned why the bribery case involving the two brothers wasn\u2019t being tried together. Why, when Wu Min\u2019s case had reached the court, was Wu Zhong\u2019s still under investigation, deliberately depriving the brothers of their right to defense? She argued that proceeding with Wu Min\u2019s case in a \u201cblack box\u201d manner, without the family-appointed lawyer having access to the prosecution\u2019s evidence, was unjust. Faced with Lawyer He Zhijuan\u2019s questioning, the members of the collegial panel, including Deputy Chief Justice Liu Sailian, did not dare to meet her. Finally, a judge from the criminal tribunal received her and took the documents. Yet, to this day, the court has refused to respond to Lawyer He Zhijuan\u2019s request for a joint trial of Wu Zhong and Wu Min.<\/p>\n\n\n\n

\u4f55\u667a\u5a1f\u5f8b\u5e08\u5f53\u5929\u53c8\u53bb\u8bb8\u6625\u6797\u7684\u5f8b\u6240\uff0c\u60f3\u5f53\u9762\u95ee\u8bb8\u6625\u6797\uff1a\u4e0d\u7ba1\u4f60\u662f\u8c01\u5b89\u6392\u8fdb\u6765\u7684\uff0c\u4eba\u90fd\u8981\u6709\u70b9\u804c\u4e1a\u7cbe\u795e\u5417\uff1f\u662f\u72d7\u5c31\u8981\u770b\u5bb6\uff0c\u662f\u732b\u5c31\u8981\u6293\u8017\u5b50\u3002\u4f60\u73b0\u5728\u5360\u7740\u5434\u654f\u8fa9\u62a4\u4eba\u7684\u5751\uff0c\u4f60\u6253\u7b97\u600e\u4e48\u7ed9\u4ed6\u8fa9\u62a4\uff1f\u5434\u654f\u4f5c\u4e3a\u4e00\u4e2a\u6b63\u5385\u7ea7\u5e72\u90e8\uff0c\u5f53\u5b98\u51e0\u5341\u5e74\uff0c\u6c5f\u897f\u7eaa\u59d4\u4e0a\u767e\u4eba\u7684\u4e13\u6848\u7ec4\u67e5\u4e86\u4e00\u5e74\u534a\uff0c\u6700\u540e\u7aef\u51fa\u6765\u7684\uff0c\u6ca1\u6709\u4e00\u7b14\u5916\u4eba\u5bf9\u4ed6\u7684\u884c\u8d3f\uff0c\u5168\u90e8\u76841190\u4e07\u53d7\u8d3f\uff0c\u90fd\u662f\u4eb2\u5f1f\u5f1f\u5434\u5fe0\u7ed9\u4ed6\u7684\uff0c\u800c\u4e14\uff0c\u5168\u90e8\u79bb\u5947\u53e4\u602a\uff1a\u5434\u5fe02008\u5e74\u82b1180\u4e07\u5728\u5317\u4eac\u4e70\u4e86\u5957\u623f\uff0c2018\u5e74\u4ee5450\u4e07\u5356\u7ed9\u4e86\u54e5\u54e5\u5434\u654f\uff0c\u6c5f\u897f\u7eaa\u59d4\u5c31\u8ba4\u5b9a\uff0c\u8fd9\u5957\u623f\u5f53\u65f6\u7684\u5e02\u573a\u4ef7750\u4e07\uff0c300\u4e07\u7684\u5dee\u989d\uff0c\u5c31\u662f\u5f1f\u5f1f\u5bf9\u54e5\u54e5\u7684\u884c\u8d3f\u3002\u6c5f\u897f\u7eaa\u59d4\u53c8\u903c\u7740\u5434\u5fe0\u627f\u8ba4\u66fe\u7ecf\u8bb8\u8bfa\u5728\u54e5\u54e5\u9000\u4f11\u540e\uff0c\u7ed9\u4ed6\u548c\u5ac2\u5b50\u56db\u767e\u4e07\u517b\u8001\u8d39\uff0c\u8fd9\u79cd\u65e0\u4e2d\u751f\u6709\u7684\u517b\u8001\u8d39\u627f\u8bfa\uff0c\u4e5f\u5802\u800c\u7687\u4e4b\u5730\u5199\u8fdb\u4e86\u8d77\u8bc9\u4e66\u3002\u6c5f\u897f\u7eaa\u59d4\u8fd8\u628a\u67e5\u5230\u7684\u5434\u5fe0\u516c\u53f8\u7684\u51e0\u7b14\u5927\u989d\u53d6\u73b0\u8bb0\u5f55\uff0c\u786c\u8ba9\u5144\u5f1f\u4fe9\u627f\u8ba4\u8fd9\u5c31\u662f\u5f1f\u5f1f\u62ff\u6765\u7ed9\u54e5\u54e5\u4e86\uff0c\u4e0d\u627f\u8ba4\uff0c\u5c31\u6293\u4f60\u4eec\u5168\u5bb6\u3002<\/p>\n\n\n\n

On the same day, Lawyer He Zhijuan visited Xu Chunlin’s law office, intending to ask him face-to-face: Regardless of who arranged for you to be here, shouldn’t you have some professional integrity? If you’re a dog, you watch the house; if you’re a cat, you catch mice. Now that you occupy the position of Wu Min’s defense lawyer, how do you plan to defend him? Wu Min, as a senior official who served for decades, was investigated by a task force of over a hundred from the Jiangxi Discipline Inspection Commission for a year and a half. Yet, they produced no evidence of bribery from outsiders. All the alleged bribery of 11.9 million yuan came from his brother, Wu Zhong, and it was all incredibly bizarre: In 2008, Wu Zhong bought an apartment in Beijing for 1.8 million yuan, and sold it to his brother, Wu Min, in 2018 for 4.5 million yuan. The Jiangxi Discipline Inspection Commission determined that the market value of the apartment at the time was 7.5 million yuan, and the difference of 3 million yuan was considered bribery from the younger brother to the older. The commission also coerced Wu Zhong into admitting he had promised to give his brother and sister-in-law four million yuan for their retirement after he stepped down. This baseless promise of retirement funds was brazenly included in the indictment. Furthermore, the commission took several large cash withdrawal records from Wu Zhong\u2019s company and forced the brothers to admit this was money the younger brother had given to the older. If they didn\u2019t admit it, the entire family would be arrested.<\/p>\n\n\n\n

\u8fd9\uff0c\u5c31\u662f\u725b\u903c\u7684\u6c5f\u897f\u7eaa\u59d4\u7f57\u7ec7\u51fa\u7684\u5f1f\u5f1f\u5411\u54e5\u54e5\u884c\u8d3f\u6848\uff0c\u5176\u7f57\u7ec7\u6c34\u5e73\uff0c\u6bd4\u4e00\u5343\u591a\u5e74\u524d\u7684\u6765\u4fca\u81e3\u524d\u8f88\u4e5f\u4e0d\u9051\u591a\u8ba9\u5427\uff1f\u4f60\u8bb8\u6625\u6797\u65e2\u7136\u63a5\u53d7\u4e86\u5b98\u65b9\u7684\u5b89\u6392\uff0c\u8981\u5f53\u8fd9\u4e2a\u6cd5\u63f4\u5f8b\u5e08\uff0c\u9762\u5bf9\u6765\u81ea\u884c\u8d3f\u4eba\u7684\u63ed\u53d1\uff0c\u4f60\u8ba4\u4e3a\u5434\u654f\u662f\u6709\u7f6a\u8fd8\u662f\u65e0\u7f6a\uff0c\u4f60\u6253\u7b97\u600e\u4e48\u7ed9\u4ed6\u8fa9\u62a4\uff1f<\/p>\n\n\n\n

This is the extraordinary case fabricated by the Jiangxi Discipline Inspection Commission, alleging that the younger brother bribed the older brother. Their level of fabrication might well compete with that of Lai Junchen from over a thousand years ago. Xu Chunlin, since you’ve accepted the official assignment to be this legal aid lawyer, faced with accusations from the alleged briber, do you think Wu Min is guilty or innocent? How do you plan to defend him?<\/p>\n\n\n\n

\u7ed3\u679c\uff0c\u8bb8\u6625\u6797\u5413\u5f97\u8fde\u7167\u9762\u90fd\u4e0d\u6562\u6253\uff0c\u4ed6\u5f8b\u6240\u7684\u524d\u53f0\u8054\u7cfb\u8bb8\u672c\u4eba\u540e\uff0c\u5148\u662f\u8bf4\u8bb8\u4e3b\u4efb\u5728\u5916\u8fb9\uff0c\u9a6c\u4e0a\u56de\u6765\uff0c\u540e\u6765\uff0c\u5c31\u8bf4\u8bb8\u4e3b\u4efb\u53bb\u4e86\u5916\u5730\uff0c\u56de\u4e0d\u6765\u4e86\u3002\u8fd9\u4e0d\u662f\u5fc3\u865a\u662f\u4ec0\u4e48\uff01<\/p>\n\n\n\n

As a result, Xu Chunlin was so frightened he didn\u2019t even dare to meet face-to-face. After the front desk at his law office contacted him, they initially said he was out but would return soon. Later, they said he had gone out of town and couldn\u2019t come back. If this isn\u2019t guilty conscience, what is?<\/p>\n\n\n\n

\u4f46\u662f\uff0c\u8bb8\u6625\u6797\u5fc3\u865a\uff0c\u5f8b\u5e08\u754c\u7684\u8d28\u7591\uff0c\u6574\u4e2a\u6cd5\u5f8b\u5708\u548c\u5168\u56fd\u4eba\u6c11\u7684\u5173\u6ce8\uff0c\u90fd\u4e0d\u80fd\u6253\u6d88\u6c5f\u897f\u548c\u9e70\u6f6d\u65b9\u9762\u6478\u9ed1\u628a\u5434\u654f\u6848\u5224\u4e86\u7684\u51b3\u5fc3\u3002\u4e8c\u4f1a\u5176\u95f4\uff0c\u9e70\u6f6d\u4e2d\u9662\u7530\u7518\u9716\u9662\u957f\u4eb2\u81ea\u5230\u5317\u4eac\uff0c\u901a\u8fc7\u201c\u7ec4\u7ec7\u4e0a\u201d\u8981\u6c42\u5411\u5434\u654f\u7684\u5973\u513f\u5f53\u9762\u89e3\u91ca\uff1a\u4e0d\u662f\u6211\u4eec\u975e\u8981\u7ed9\u4f60\u7236\u4eb2\u5b89\u6392\u6cd5\u63f4\u5f8b\u5e08\uff0c\u800c\u662f\u4f60\u7236\u4eb2\u575a\u51b3\u8981\u6c42\u7ec4\u7ec7\u4e0a\u7ed9\u4ed6\u5b89\u6392\u6cd5\u5f8b\u63f4\u52a9\u5f8b\u5e08\u3002\u6211\u4eec\u8fd9\u6b21\u6765\uff0c\u5c31\u662f\u60f3\u548c\u5bb6\u5c5e\u6c9f\u901a\u7684\uff0c\u8fd9\u6837\u5bf9\u4f60\u4eec\u597d\u3002\u5434\u654f\u7684\u5bb6\u5c5e\u8868\u793a\uff1a\u89c1\u9762\u53ef\u4ee5\uff0c\u6211\u4eec\u8bf7\u7684\u5f20\u5e86\u65b9\u5f8b\u5e08\u5fc5\u987b\u5728\u573a\uff01\u7530\u7518\u9716\u9662\u957f\u4e00\u542c\u5230\u5f20\u5e86\u65b9\u5f8b\u5e08\u7684\u540d\u5b57\u5c31\u6765\u6c14\uff1a\u4ed6\u662f\u4e2a\u8fdd\u6cd5\u5f8b\u5e08\uff0c\u4ed6\u53d1\u77ed\u4fe1\u5a01\u80c1\u6211\u4eec\u9e70\u6f6d\u4e2d\u9662\u7684\u9886\u5bfc\uff0c\u4e0d\u80fd\u8ba9\u4ed6\u4e00\u8d77\u89c1\u9762\u3002<\/p>\n\n\n\n

Yet, Xu Chunlin\u2019s guilty conscience, the doubts of the legal community, and the attention of the entire legal circle and the national public have not dissuaded the Jiangxi and Yingtan authorities from their determination to unjustly conclude Wu Min\u2019s case. During the Two Sessions, President Tian Ganlin of the Yingtan Intermediate Court personally went to Beijing, requesting to explain face-to-face to Wu Min\u2019s daughter: It wasn\u2019t that they insisted on assigning a legal aid lawyer to her father, but that her father had firmly requested the organization to arrange a legal aid lawyer for him. They claimed their visit was intended to communicate with the family for their benefit. Wu Min\u2019s family responded: The meeting could take place, but their lawyer, Zhang Qingfang, must be present. Upon hearing Zhang Qingfang\u2019s name, President Tian Ganlin became angry: \u201cHe\u2019s a lawyer who violates the law; he sent threatening messages to our Yingtan Intermediate Court\u2019s leadership. He cannot be allowed to attend the meeting.\u201d<\/p>\n\n\n\n

\u51e0\u5929\u540e\uff0c\u7530\u7518\u9716\u8fd8\u4e0d\u6b7b\u5fc3\uff0c\u53c8\u5411\u5448\u654f\u5bb6\u5c5e\u4f20\u8bdd\uff1a\u89c1\u4e0d\u89c1\uff0c\u90fd\u4e0d\u5f71\u54cd\u6211\u4eec\u5f00\u5ead\u5ba1\u7406\uff0c\u800c\u4e14\uff0c\u4f60\u4eec\u5317\u4eac\u7684\u623f\u5b50\uff0c\u4f60\u7238\u4e5f\u51fa\u94b1\u4e86\uff0c\u6211\u4eec\u4e5f\u53ef\u4ee5\u67e5\uff01 <\/p>\n\n\n\n

A few days later, Tian Ganlin, still not giving up, relayed a message to Wu Min\u2019s family: Whether or not they met would not affect the court proceedings. Moreover, they could investigate the family\u2019s property in Beijing, which their father had also contributed to.<\/p>\n\n\n\n

\u597d\u4e2a\u7530\u7518\u9716\u9662\u957f\uff0c\u67e5\u4e0d\u67e5\u5bb6\u5c5e\uff0c\u67e5\u4e0d\u67e5\u5317\u4eac\u7684\u623f\u5b50\uff0c\u5728\u4ed6\u53e3\u4e2d\uff0c\u5b8c\u5168\u4e0d\u662f\u4f9d\u636e\u4e8b\u5b9e\u548c\u6cd5\u5f8b\uff0c\u800c\u662f\u53ea\u51ed\u4ed6\u773c\u4e2d\u5bb6\u5c5e\u662f\u4e0d\u662f\u914d\u5408\u4ed6\u4eec\u529e\u51a4\u6848\uff01 <\/p>\n\n\n\n

Such is President Tian Ganlin, whether investigating the family or the property in Beijing, it\u2019s not based on facts and law in his eyes, but solely on whether the family cooperates with their wrongful case!<\/p>\n\n\n\n

This demonstrates that the Jiangxi Discipline Inspection Commission, Yingtan\u2019s prosecutorial and judicial bodies, and Xu Chunlin do not allow a fair debate, denying the family-appointed lawyer the opportunity to participate, and forcibly assigning another player to the opposing side of the match \u2013 a deed done with utter determination!<\/p>\n\n\n\n

Therefore, as a lawyer with 23 years of practice, a Ph.D. in criminal law from Peking University who never spent a day in a state-owned unit after graduation and directly joined the legal profession, I solemnly warn my colleagues nationwide: If we allow the Jiangxi Discipline Inspection Commission, Tian Ganlin, Liu Sailian, and Xu Chunlin to succeed, there is no future for criminal defense in China, no future for the rule of law in China, and no future for China!<\/p>\n\n\n\n
