\u672c\u4eba\u662f\u5317\u4eac\u5e02\u6c49\u9f0e\u8054\u5408\u5f8b\u5e08\u4e8b\u52a1\u6240\u5f20\u5e86\u65b9\u5f8b\u5e08\uff0c\u5728\u4ee3\u7406\u7531\u6c5f\u897f\u7701\u7eaa\u59d4\u8c03\u67e5\u5904\u7406\uff0c\u76ee\u524d\u6b63\u5728\u9e70\u6f6d\u5e02\u4e2d\u7ea7\u4eba\u6c11\u6cd5\u9662\u5ba1\u7406\u7684\u524d\u5409\u5b89\u5e02\u4eba\u5927\u4e3b\u4efb\u5434\u654f\u53d7\u8d3f\u6848\u8fc7\u7a0b\u4e2d\uff0c\u6211\u53d1\u73b0\u4e3b\u6301\u8be5\u6848\u5ba1\u7406\u7684\u9e70\u6f6d\u4e2d\u9662\u7530\u7518\u9716\u9662\u957f\u3001\u5218\u8d5b\u8fde\u526f\u9662\u957f\u5b8c\u5168\u4e27\u5931\u4e86\u4e13\u4e1a\u6cd5\u5b98\u7684\u804c\u4e1a\u64cd\u5b88\uff0c\u65e0\u6761\u4ef6\u5730\u914d\u5408\u6c5f\u897f\u7eaa\u59d4\u5236\u9020\u51a4\u6848\uff0c\u975e\u6cd5\u5265\u593a\u5434\u654f\u7684\u8fa9\u62a4\u6743\uff0c\u975e\u6cd5\u5265\u593a\u884c\u8d3f\u4eba\u540c\u6848\u540c\u5ead\u5ba1\u5224\u7684\u6743\u5229\uff0c\u5984\u56fe\u5728\u5434\u654f\u5bb6\u5c5e\u4e3a\u5176\u8058\u8bf7\u7684\u5f8b\u5e08\u4e0d\u5230\u5ead\uff0c\u5434\u654f\u7684\u884c\u8d3f\u4eba\u4e0d\u5230\u5ead\u7684\u60c5\u51b5\u4e0b\uff0c\u9ed1\u7bb1\u64cd\u4f5c\uff0c\u5c06\u4e00\u8d77\u6c5f\u897f\u7eaa\u59d4\u70ae\u5236\u7684\u7279\u5927\u51a4\u6848\uff0c\u4ee5\u4eba\u6c11\u6cd5\u9662\u7684\u540d\u4e49\u6700\u7ec8\u5b8c\u6210\u3002<\/p>\n\n\n\n

I am Zhang Qingfang, a lawyer at Beijing Handing United Law Firm. While representing Wu Min, the former director of the People’s Congress of Ji’an City, Jiangxi Province, whose bribery case is currently being tried at the Intermediate People’s Court of Yingtan, I have discovered that the presiding judges, Dean Tian Ganlin and Deputy Dean Liu Sailian of the Yingtan Intermediate Court, have completely lost their professional judicial ethics. They have unconditionally cooperated with the Jiangxi Commission for Discipline Inspection (CDI) to fabricate a miscarriage of justice, illegally depriving Wu Min of his right to defense and the briber’s right to a joint trial. They aim to manipulate behind closed doors and finalize this major wrongful case crafted by the Jiangxi CDI in the name of the People’s Court, without the presence of Wu Min’s family-appointed lawyer or the briber.<\/p>\n\n\n\n

\u672c\u4eba\u4f5c\u4e3a\u4e00\u4e2a\u6cd5\u5f8b\u4eba\uff0c\u5982\u679c\u4efb\u7531\u6c5f\u897f\u7eaa\u59d4\u548c\u9e70\u6f6d\u4e2d\u9662\u8086\u610f\u5984\u4e3a\u800c\u4e0d\u4e3e\u62a5\uff0c\u4e0d\u5236\u6b62\uff0c\u5c06\u6765\u5176\u4ed6\u5730\u65b9\u7684\u7eaa\u59d4\u548c\u6cd5\u9662\u4e5f\u4f1a\u6709\u6837\u5b66\u6837\uff0c\u5730\u65b9\u7eaa\u59d4\u5c31\u6709\u4e86\u968f\u610f\u6293\u4eba\uff0c\u4efb\u610f\u786e\u5b9a\u72af\u7f6a\u91d1\u989d\uff0c\u5168\u7a0b\u8131\u79bb\u6765\u81ea\u5bb6\u5c5e\u3001\u5f8b\u5e08\u3001\u793e\u4f1a\u548c\u5176\u4ed6\u56fd\u5bb6\u673a\u5173\u76d1\u7763\u5236\u7ea6\u7684\u6cd5\u5916\u7279\u6743\uff0c\u4e2d\u56fd\u5730\u65b9\u6cd5\u9662\u7cfb\u7edf\u5c06\u5f7b\u5e95\u4e27\u5931\u72ec\u7acb\u5730\u4f4d\uff0c\u6ca6\u4e3a\u5730\u65b9\u7eaa\u59d4\u7f57\u7ec7\u5047\u6848\u7684\u5e2e\u51f6\u548c\u5de5\u5177\uff0c\u4e2d\u56fd\u4e00\u5343\u591a\u4e07\u516c\u52a1\u4eba\u5458\u5c06\u4e0d\u518d\u62e5\u6709\u8fa9\u62a4\u6743\uff0c\u4e2d\u56fd\u5211\u4e8b\u6cd5\u6cbb\u5c06\u6210\u4e3a\u4e00\u5177\u6ca1\u6709\u7075\u9b42\u7684\u50f5\u5c38\uff01<\/p>\n\n\n\n

As a legal professional, if I allow the Jiangxi CDI and the Yingtan Intermediate Court to act recklessly without reporting or stopping them, other local CDIs and courts might follow suit. Local CDIs could arbitrarily detain people and set criminal amounts, completely isolated from supervision by families, lawyers, society, and other state organs. This would grant them extrajudicial privileges. The Chinese local court system would completely lose its independence, becoming an accomplice and tool for local CDIs to fabricate cases. Over ten million Chinese civil servants would no longer have the right to defense, and China’s criminal justice would become a soulless zombie.<\/p>\n\n\n\n

\u5434\u654f\u6848\uff0c\u5b58\u5728\u4ee5\u4e0b\u4e25\u91cd\u7a0b\u5e8f\u8fdd\u6cd5\uff1a<\/p>\n\n\n\n

In Wu Min’s case, there are serious procedural violations:<\/p>\n\n\n\n

1\u3001 \u6c5f\u897f\u7701\u7eaa\u59d4\u4e13\u6848\u7ec4\u5047\u501f\u5730\u65b9\u516c\u5b89\u548c\u7eaa\u59d4\u540d\u4e49\uff0c\u8e22\u5f00\u76d1\u5bdf\u6cd5\u548c\u5211\u4e8b\u8bc9\u8bbc\u6cd5\uff0c\u8d85\u8d8a\u6cd5\u5b9a\u804c\u6743\u548c\u6cd5\u5b9a\u671f\u9650\u529e\u6848\u3002\u4e3a\u4e86\u6784\u9677\u5434\u654f\uff0c\u6c5f\u897f\u7701\u7eaa\u59d4\u5148\u63d0\u524d\u534a\u5e74\u5c06\u5434\u654f\u7684\u4eb2\u5f1f\u5f1f\uff0c\u5409\u5b89\u6c11\u8425\u4f01\u4e1a\u5bb6\u5434\u5fe0\u4e8e2022\u5e7412\u6708\u4ee5\u5f3a\u5b89\u7684\u4ecb\u7ecd\u5356\u6deb\u7f6a\uff0c\u7531\u6a1f\u6811\u53bf\u516c\u5b89\u5c40\u51fa\u4e86\u6307\u5b9a\u5c45\u6240\u76d1\u89c6\u5c45\u4f4f\u624b\u7eed\uff0c\u628a\u5434\u5fe0\u5173\u62bc\u5728\u6a1f\u6811\u7eaa\u59d4\u7684\u6240\u8c13\u5ec9\u653f\u6559\u80b2\u57fa\u5730\u3002\u516d\u4e2a\u6708\u540e\uff0c\u53c8\u8ba9\u5b89\u4e49\u53bf\u7eaa\u59d4\u4ee5\u884c\u8d3f\u7f6a\uff0c\u628a\u5434\u5fe0\u7559\u7f6e\u5728\u5b89\u4e49\u53bf\u5ec9\u653f\u57fa\u5730\u3002\u5176\u95f4\uff0c\u90fd\u662f\u6c5f\u897f\u7eaa\u59d4\u7684\u4e13\u6848\u7ec4\u4e00\u5929\u4e09\u73ed\uff0c\u5171\u5341\u516b\u4e2a\u5c0f\u65f6\u903c\u95ee\u5434\u5fe0\uff0c\u8ba9\u4ed6\u4ea4\u5f85\u54e5\u54e5\u5434\u654f\u7684\u95ee\u9898\u3002\u5434\u5fe0\u5bb6\u5c5e\u8bf7\u7684\u5f8b\u5e08\u8981\u6c42\u4f1a\u89c1\uff0c\u51fa\u5177\u6307\u5b9a\u5c45\u6240\u76d1\u89c6\u5c45\u4f4f\u624b\u7eed\u7684\u6a1f\u6811\u516c\u5b89\u5c40\u8bf4\uff1a\u8fd9\u662f\u7eaa\u59d4\u7684\u6848\u5b50\uff0c\u6211\u4eec\u7ba1\u4e0d\u4e86\u3002\u8f6c\u5230\u5b89\u4e49\u5ec9\u653f\u57fa\u5730\u540e\uff0c\u5c31\u66f4\u6ca1\u6709\u4e86\u5f8b\u5e08\u4f1a\u89c1\u7684\u673a\u4f1a\u3002\u5434\u5fe0\u88ab\u4ee5\u6d89\u5acc\u4ecb\u7ecd\u5356\u6deb\u7f6a\u5173\u62bc\u534a\u5e74\uff0c\u4ee5\u6d89\u5acc\u884c\u8d3f\u7f6a\u5173\u62bc\u534a\u5e74\uff0c\u5171\u4e00\u5e74\u540e\uff0c\u6c5f\u897f\u7eaa\u59d4\u53c8\u4e8e2023\u5e7412\u6708\u4efd\uff0c\u8ba9\u5357\u660c\u5e02\u516c\u5b89\u5c40\u9752\u5c71\u6e56\u5206\u5c40\uff0c\u4ee5\u6d89\u5acc\u865a\u5f00\u589e\u503c\u7a0e\u53d1\u7968\u7f6a\uff0c\u7ee7\u7eed\u5bf9\u5434\u5fe0\u6307\u5b9a\u5c45\u6240\u76d1\u89c6\u5c45\u4f4f\uff0c\u5730\u70b9\u662f\u5728\u7eaa\u76d1\u59d4\u7684\u8fdb\u8d24\u5ec9\u653f\u6559\u80b2\u4e2d\u5fc3\uff0c\u8fd8\u662f\u7531\u7701\u7eaa\u59d4\u4e13\u6848\u7ec4\u7684\u4eba\u903c\u95ee\u4ed6\u5411\u4eb2\u54e5\u54e5\u5434\u654f\u884c\u8d3f\u7684\u6240\u8c13\u4e8b\u5b9e\u3002\u603b\u4e4b\uff0c\u5728\u5434\u5fe0\u6848\u4e2d\uff0c\u5730\u65b9\u516c\u5b89\u5b8c\u5168\u6210\u4e86\u6c5f\u897f\u7701\u7eaa\u59d4\u5236\u9020\u5047\u6848\u7684\u5de5\u5177\uff0c\u662f\u8c01\u7ed9\u7eaa\u59d4\u7684\u8fd9\u4e2a\u6743\u529b\uff1f<\/p>\n\n\n\n

1. The Jiangxi CDI’s special team, under the guise of local public security and CDI, bypassed the Supervisory Law and Criminal Procedure Law, exceeding their statutory powers and time limits for handling cases. To frame Wu Min, they first detained his younger brother, Wu Zhong, a private entrepreneur from Ji’an, six months in advance in December 2022, on trumped-up charges of introducing prostitution, facilitated by the Changshu County Public Security Bureau, which issued a residential surveillance order and detained Wu Zhong at the so-called Integrity Education Base of the Changshu CDI. Six months later, the Anyi County CDI detained Wu Zhong at the Anyi County Integrity Base on charges of bribery. During this time, the Jiangxi CDI’s special team interrogated Wu Zhong in three shifts a day, totaling eighteen hours, to extract confessions about his brother Wu Min. Wu Zhong’s family-hired lawyer requested a meeting, but the Changshu Public Security Bureau, which issued the residential surveillance order, said, “This is a CDI case, we can’t manage it.” After transferring to the Anyi Integrity Base, there were even fewer opportunities for lawyer visits. Wu Zhong was detained for six months on suspicion of introducing prostitution and another six months on suspicion of bribery. In December 2023, the Qingshanhu Branch of Nanchang Public Security Bureau continued to hold Wu Zhong under residential surveillance on suspicion of issuing fake VAT invoices, at the Jinxian Integrity Education Center of the Discipline Inspection Commission, where the provincial CDI’s special team continued to coerce him into confessing the so-called facts of bribing his older brother, Wu Min. In essence, in Wu Zhong’s case, the local public security became a tool for the Jiangxi CDI to fabricate cases. Who gave the CDI this power?<\/p>\n\n\n\n

\u4e8c\u3001\u975e\u6cd5\u5265\u593a\u5434\u654f\u7684\u8fa9\u62a4\u6743\u30022023\u5e745\u670830\u65e5\uff0c\u6c5f\u897f\u7701\u7eaa\u59d4\u76d1\u59d4\u4ee5\u6d89\u5acc\u53d7\u8d3f\u7f6a\u5bf9\u5434\u654f\u7559\u7f6e\uff0c5\u4e2a\u591a\u6708\u540e\u5c06\u5176\u4ece\u5ec9\u653f\u4e2d\u5fc3\u8f6c\u79fb\u81f3\u9e70\u6f6d\u5e02\u5f3a\u5236\u9694\u79bb\u6212\u6bd2\u6240\uff08\u9e70\u6f6d\u5e02\u4eba\u6c11\u533b\u9662\u76d1\u7ba1\u5206\u9662\uff09\u7f81\u62bc\uff0c\u540e\u79fb\u9001\u9e70\u6f6d\u5e02\u68c0\u5bdf\u9662\u8d77\u8bc9\uff0c\u68c0\u5bdf\u9662\u4e8e2023\u5e7412\u670822\u65e5\u4ee5\u5434\u654f\u6d89\u5acc\u53d7\u8d3f\u7f6a\uff0c\u8d77\u8bc9\u81f3\u9e70\u6f6d\u5e02\u4e2d\u7ea7\u6cd5\u9662\u3002\u4f46\u662f\u76f4\u52302024\u5e741\u670811\u65e5\uff0c\u6c5f\u897f\u7701\u7eaa\u76d1\u59d4\u624d\u5bf9\u5176\u5b98\u5ba3\u3002<\/p>\n\n\n\n

2. Illegal deprivation of Wu Min’s right to defense. On May 30, 2023, the Jiangxi CDI detained Wu Min on suspicion of bribery, and more than five months later, transferred him from the Integrity Center to the Yingtan City Compulsory Isolation Rehabilitation Center (supervised branch of Yingtan People’s Hospital) for detention, later transferring him to the Yingtan City Procuratorate for prosecution. The Procuratorate charged him with bribery on December 22, 2023, and filed the case with the Yingtan Intermediate Court. However, it was not until January 11, 2024, that the Jiangxi CDI officially announced it.<\/p>\n\n\n\n

2024\u5e741\u670815\u65e5\uff0c\u738b\u6625\u4e3d\u5f8b\u5e08\u5e26\u7740\u5bb6\u5c5e\u7684\u59d4\u6258\uff0c\u5230\u9e70\u6f6d\u76d1\u7ba1\u533b\u9662\u4f1a\u89c1\u5434\u654f\uff0c\u76d1\u7ba1\u533b\u9662\u8bf4\uff1a\u8fd9\u662f\u7eaa\u59d4\u7684\u6848\u5b50\uff0c\u5f8b\u5e08\u4f1a\u89c1\uff0c\u5fc5\u987b\u7eaa\u59d4\u540c\u610f\u3002\u738b\u6625\u4e3d\u5f8b\u5e08\u8d28\u95ee\uff1a\u6848\u5b50\u90fd\u5230\u6cd5\u9662\u4e86\uff0c\u7eaa\u59d4\u6709\u4ec0\u4e48\u6743\u529b\u5e72\u9884\u5f8b\u5e08\u4f1a\u89c1\uff1f\u76d1\u7ba1\u533b\u9662\u7684\u4eba\u8bf4\u6211\u4eec\u53ea\u80fd\u542c\u7eaa\u59d4\u7684\u3002<\/p>\n\n\n\n

On January 15, 2024, lawyer Wang Chunli, carrying the family’s mandate, went to meet Wu Min at the Yingtan Supervisory Hospital, where the hospital stated: “This is a CDI case; lawyer visits must be approved by the CDI.” Lawyer Wang Chunli challenged this: “The case is already in court, what right does the CDI have to interfere with lawyer visits?” The hospital staff replied that they could only follow the CDI’s instructions.<\/p>\n\n\n\n

\u5176\u5b9e\uff0c\u5c31\u5728\u8fd9\u65f6\uff0c\u5728\u6c5f\u897f\u7eaa\u59d4\u7684\u6307\u793a\u4e0b\uff0c\u9e70\u6f6d\u68c0\u6cd5\u548c\u53f8\u6cd5\u5c40\u5df2\u7ecf\u7ed9\u5434\u654f\u5b89\u6392\u4e00\u4e86\u4f4d\u6cd5\u5f8b\u63f4\u52a9\u5f8b\u5e08\uff0c\u5c31\u662f\u672c\u5730\u7684\u5434\u6587\u5146\u5f8b\u5e08\u3002\u5f53\u7740\u5bb6\u5c5e\u7684\u9762\uff0c\u5434\u6587\u5146\u975e\u5e38\u5766\u8bda\uff1a\u4f60\u4eec\u5bb6\u8fd9\u4e2a\u6848\u5b50\uff0c\u5c31\u662f\u6709\u4eba\u501f\u5200\u6740\u4eba\uff0c\u8fd9\u5c31\u662f\u4e2a\u653f\u6cbb\u6848\u5b50\uff0c\u4f60\u4eec\u4e0d\u5c31\u662f\u6d89\u53ca\u4e00\u5957\u623f\u5b50\uff0c\u8fd9\u53c8\u600e\u4e48\u6837\uff1f\u8584\u7199\u6765\u4e0d\u4e5f\u662f\u5957\u623f\u5b50\uff1f\u4e00\u67e5\uff0c\u67e5\u51fa\u6765\u4e00\u4e2a\u6e05\u5b98\u3002\u8fd9\u53c8\u600e\u4e48\u6837\uff1f\u8fd9\u5c31\u662f\u653f\u6cbb\uff01\u674e\u514b\u5f3a\u603b\u7406\u4e0d\u90fd\u6b7b\u4e86\u5417\uff1f\u6b7b\u4e86\u4e0d\u5c31\u6b7b\u4e86\uff1f\u8fd9\u5c31\u662f\u653f\u6cbb\u3002\u4f60\u4eec\u8fd8\u6709\u4ec0\u4e48\u60f3\u4e0d\u5f00\u8fc7\u4e0d\u53bb\u7684\uff01<\/p>\n\n\n\n

In fact, at that time, under the directive of the Jiangxi CDI, the Yingtan Procuratorate and Justice Bureau had already arranged a legal aid lawyer for Wu Min, local lawyer Wu Wenzhao. In front of the family, Wu Wenzhao was very candid: “Your family’s case is a matter of using someone else to commit murder; it’s a political case. Isn’t it just about a house? Wasn’t Bo Xilai also about a house? They investigated and found a clean official. So what? This is politics! Didn’t Premier Li Keqiang die? He died, so he died. That’s politics. What can’t you get over?”<\/p>\n\n\n\n

\u5bf9\u4e8e\u5434\u6587\u5146\u5f8b\u5e08\u5927\u9006\u4e0d\u9053\u7684\u8a00\u8bba\uff0c\u5f20\u5e86\u65b9\u548c\u738b\u6625\u4e3d\u5f8b\u5e08\u4e8e2024\u5e741\u670818\u65e5\u5728\u7f51\u7edc\u4e0a\u8fdb\u884c\u4e86\u516c\u5f00\uff0c\u5e76\u4e3e\u62a5\u5230\u9e70\u6f6d\u4e2d\u9662\uff0c\u9e70\u6f6d\u4e2d\u9662\u4e3b\u5ba1\u5434\u654f\u6848\u7684\u527d\u5ba2\u526f\u9662\u957f\uff08\u5728\u5357\u4eac\u5927\u5b66\u8bfb\u5728\u804c\u6cd5\u5f8b\u7855\u58eb\u65f6\u7684\u6bd5\u4e1a\u8bba\u6587\u6284\u88ad\u738763%\uff09\u5218\u8d5b\u8fde\u884c\u52a8\u8fc5\u901f\uff0c\u7b2c\u4e8c\u5929\u5c31\u64a4\u6362\u6389\u4e86\u5434\u6587\u5146\uff0c\u540c\u65f6\u53c8\u65e0\u7f1d\u5bf9\u63a5\u5730\u7ed9\u5434\u654f\u5b89\u6392\u4e86\u65b0\u7684\u6cd5\u63f4\u5f8b\u5e08\u8bb8\u6625\u6797\uff01<\/p>\n\n\n\n

Regarding the outrageous statements by lawyer Wu Wenzhao, Zhang Qingfang and lawyer Wang Chunli publicly exposed them online on January 18, 2024, and reported them to the Yingtan Intermediate Court. Deputy Dean Liu Sailian of the Yingtan Intermediate Court, who presides over Wu Min’s case and whose master’s thesis at Nanjing University had a 63% plagiarism rate, acted quickly. The next day, he replaced Wu Wenzhao and seamlessly arranged a new legal aid lawyer, Xu Chunlin, for Wu Min.<\/p>\n\n\n\n

Regarding the forceful exclusion of family-hired lawyers by the Jiangxi CDI and Yingtan Intermediate Court, and the imposition of legal aid lawyers on the parties, legal professionals pointed out sharply: This is darker than match-fixing! Match-fixing only affects the result. Planting a placeholder lawyer is like depriving the opposing player of even the chance to play. If all the players are yours, does the opposition have any chance of winning? If such arrangements are tolerated, is there any space left for criminal defense lawyers in China in cases of official crimes?<\/p>\n\n\n\n

In firm opposition to the imposition of placeholder lawyers on Wu Min by Yingtan authorities, we organized a major essay competition on placeholder defense before the Spring Festival. In just eight days, we received 66 papers from lawyers and academics nationwide, thoroughly discussing the manifestation and harms of placeholder defense. We also submitted the collection of essays and a summary report to the responsible authorities, who indicated they would support the family’s hired lawyers. However, to this day, our country, which has devised a quadripartite consultation mechanism involving the judiciary, the prosecutor’s office, and the lawyers’ association, has not responded to our demands for the right to defense and visitation.<\/p>\n\n\n\n

However, once the Public Security Ministry’s Supervision Bureau heard that it was a case handled by the Jiangxi CDI, they indicated that it would be difficult to address.<\/p>\n\n\n\n

We also reported to the Jiangxi High Court the illegal exclusion of family-hired lawyers by the Yingtan Intermediate Court, but the Jiangxi High Court, upon seeing that it was a case handled by the provincial CDI, directly refused to accept the complaint.<\/p>\n\n\n\n

If local CDIs are allowed to retain the power to exclude lawyers hired by families after transferring their cases to the judiciary, what is the purpose of having a defense system?<\/p>\n\n\n\n

Deprivation of the briber’s right to defense. In this case, the entire amount of RMB 11.9 million in bribes attributed to Wu Min by the Jiangxi CDI was given by his younger brother, Wu Zhong. As paired offenders in bribery and receiving bribery, only by ensuring that both parties to the money transaction are tried together can the truth be uncovered. However, the Jiangxi CDI deliberately split the case illegally; Wu Min’s bribery case was already prosecuted last December, and Wu Zhong, the briber, has still not been transferred to the procuratorate. The purpose of the Jiangxi CDI’s arrangement is to prevent the lawyers of the Wu brothers from seeing the CDI’s case files, preventing them from obtaining evidence of the CDI’s illegal case handling before the verdict in Wu Min’s case. Wu Zhong’s lawyers have repeatedly gone to the Yingtan Intermediate Court, requesting a joint trial of Wu Zhong and Wu Min to help clarify the truth, or at least to allow Wu Zhong to testify as a key witness in Wu Min’s case. However, the Yingtan Intermediate Court initially refused to respond to this entirely legitimate request, and now they are not even answering the lawyers’ calls. Is there a more malicious and shameful court than one that refuses to let the briber testify to the truth in a bribery case?<\/p>\n\n\n\n

What exactly are the Jiangxi CDI and Yingtan Intermediate Court afraid of by so calculatingly refusing the family’s hired lawyers and denying Wu Zhong, the bribing brother, the opportunity to appear in Wu Min’s court? What are they trying to cover up? Can Wu Min’s case withstand substantive scrutiny?<\/p>\n\n\n\n

Regarding this, the first batch of officially arranged legal aid lawyers, Wu Wenzhao, said very bluntly in front of Wu Min’s family: “I have been a lawyer for twenty years, and I’ve never seen such an honest official in your family: not a single penny received from outsiders or businesses, no women other than his wife. But someone has used others to commit murder; they’ve gotten the provincial CDI on their side. You are wronged, but you can only accept it! As long as the provincial CDI has filed the case, would any court in the province dare not to convict? Unless you have connections in the Central Commission for Discipline Inspection.”<\/p>\n\n\n\n

Wu Min, as a senior official, has been in office for decades. After more than a year of investigation by a special team of hundreds from the Jiangxi CDI, the result they presented contained no bribes from outsiders; all RMB 11.9 million in bribes were from his younger brother, Wu Zhong, and were all bizarre: In 2008, Wu Zhong bought an apartment in Beijing for RMB 1.8 million, which he sold to his brother Wu Min in 2018 for RMB 4.5 million. The Jiangxi CDI determined that the market price of this apartment at the time was RMB 7.5 million, and the RMB 3 million difference was considered bribery from the younger brother to the older brother. The Jiangxi CDI also forced Wu Zhong to admit that he had promised to give his brother and sister-in-law RMB 4 million in retirement funds after his brother’s retirement. This baseless promise of retirement funds was also brazenly included in the indictment. The Jiangxi CDI also turned several large cash withdrawals from Wu Zhong’s company into evidence, forcing the brothers to admit this was money the younger brother gave to the older brother. If they did not admit it, their whole family would be arrested. Their level of fabricating charges is not inferior even to that of Lai Junchen from over a thousand years ago, right?<\/p>\n\n\n\n

Such a thoroughly wrongful case, in which the family strongly opposed the officially arranged legal aid lawyers and the younger brother Wu Zhong wrote a blood letter strongly requesting to tell the truth about the cruel forced confessions by the CDI’s special team in his older brother’s court, the Yingtan Intermediate Court nevertheless informed Wu Min’s family on April 7, 2024, that the case would be tried at 9 a.m. on April 11 in the Second Courtroom of the Yingtan Intermediate Court. The family’s appointed lawyers, including myself and Wang Chunli from Guiyang, were still denied by the Yingtan Intermediate Court from appearing in court to defend him on the grounds that Wu Min himself did not accept it. Likewise, the court ignored the application for Wu Zhong, the younger brother, to testify.<\/p>\n\n\n\n

\u6c5f\u897f\u7eaa\u59d4\u80fd\u591f\u5236\u9020\u51fa\u4e00\u4e2a\u4eb2\u5f1f\u5f1f\u5411\u4eb2\u54e5\u54e5\u884c\u8d3f\u6848\uff0c\u5c31\u5df2\u7ecf\u8ba9\u5168\u56fd\u8001\u767e\u59d3\u77a0\u76ee\u7ed3\u820c\u4e86\uff0c\u9e70\u6f6d\u4e2d\u9662\u4e0d\u987e\u4f53\u9762\u7c97\u66b4\u5730\u62d2\u7edd\u5434\u654f\u5bb6\u5c5e\u4e3a\u5176\u8bf7\u7684\u5f8b\u5e08\uff0c\u66f4\u8ba9\u56fd\u4eba\u5bf9\u8fd9\u4e2a\u6848\u4ef6\u7684\u5e55\u540e\u5145\u6ee1\u4e86\u597d\u5947\u3002\u800c\u6cd5\u5f8b\u754c\u826f\u5fc3\u4eba\u58eb\u5219\u5bf9\u672c\u6848\u5bf9\u4e2d\u56fd\u6cd5\u6cbb\u7684\u5f71\u54cd\u5fe7\u5fc3\u5fe1\u5fe1\uff1a\u5730\u65b9\u7eaa\u59d4\u5f3a\u52bf\u5230\u8bf4\u4e00\u4e0d\u4e8c\uff0c\u5730\u65b9\u6cd5\u9662\u5351\u5fae\u5230\u4e0d\u5982\u5974\u5a62\u3002\u5982\u6b64\u602a\u72b6\u5982\u679c\u542c\u4e4b\u4efb\u4e4b\uff0c\u8fd8\u8981\u6cd5\u9662\u5e72\u4ec0\u4e48\uff1f\u8ba9\u7eaa\u59d4\u76f4\u63a5\u5bf9\u5b98\u5458\u5b9a\u7f6a\u4e0d\u66f4\u7701\u4e8b\uff01<\/p>\n\n\n\n

The fact that the Jiangxi CDI could fabricate a case of a younger brother bribing his older brother has already stunned the public nationwide. The Yingtan Intermediate Court’s brutal refusal to accept the lawyers hired by Wu Min’s family, ignoring decency, has filled the public with curiosity about what’s really behind this case. Legal professionals with a conscience are deeply worried about the impact of this case on Chinese rule of law: local CDIs are so powerful that they brook no dissent, and local courts are so subservient they might as well be slaves. If such grotesqueries are allowed to continue unchecked, what is the point of having courts? Wouldn’t it be more straightforward to let the CDI directly convict officials?<\/p>\n\n\n\n

\u5c0a\u656c\u7684\u6700\u9ad8\u6cd5\u9662\u9886\u5bfc\uff0c\u672c\u4eba\u4f5c\u4e3a\u5434\u654f\u5bb6\u5c5e\u4e3a\u5176\u8bf7\u7684\u5f8b\u5e08\uff0c\u4e3a\u4e86\u5236\u6b62\u6c5f\u897f\u7701\u7eaa\u59d4\u548c\u9e70\u6f6d\u4e2d\u9662\u7684\u80e1\u4f5c\u975e\u4e3a\uff0c\u5df2\u7ecf\u7528\u5c3d\u4e86\u4e00\u5207\u53ef\u80fd\u7684\u624b\u6bb5\u3002\u5f88\u660e\u663e\uff0c\u8fd9\u4e2a\u6848\u5b50\uff0c\u76ee\u524d\u5728\u6c5f\u897f\u7701\u4e0d\u53ef\u80fd\u5f97\u5230\u7ea0\u6b63\uff0c\u4e5f\u53ea\u6709\u6700\u9ad8\u6cd5\u548c\u4e2d\u7eaa\u59d4\uff0c\u6709\u80fd\u529b\u7ea0\u6b63\u3002\u4e2d\u7eaa\u59d4\u662f\u5426\u6709\u52a8\u673a\u7ea0\u6b63\uff0c\u672c\u4eba\u4e0d\u53bb\u731c\u6d4b\u3002\u4f46\u662f\uff0c\u4f5c\u4e3a\u6700\u9ad8\u5ba1\u5224\u673a\u5173\u7684\u6700\u9ad8\u6cd5\uff0c\u5982\u679c\u5bf9\u804c\u52a1\u72af\u7f6a\u5ba1\u5224\u4e2d\u4eba\u6c11\u6cd5\u9662\u5b8c\u5168\u88ab\u8fb9\u7f18\u5316\uff0c\u5de5\u5177\u5316\u7684\u4e8b\u5b9e\u542c\u4e4b\u4efb\u4e4b\uff0c\u6700\u7ec8\u635f\u5bb3\u7684\uff0c\u4e0d\u4ec5\u4ec5\u662f\u6cd5\u9662\u7cfb\u7edf\u7684\u4fe1\u8a89\uff0c\u653e\u4efb\u7eaa\u68c0\u6743\u529b\u4e0d\u53d7\u5236\u7ea6\u7684\u6076\u679c\uff0c\u5c06\u662f\u5168\u56fd\u5341\u56db\u4ebf\u4eba\uff0c\u4eba\u4eba\u81ea\u5371\uff0c\u6ca1\u4eba\u80fd\u72ec\u4eab\u5b89\u5168\u548c\u5c0a\u4e25\u3002<\/p>\n\n\n\n

Respected leaders of the Supreme Court, as the lawyer hired by Wu Min’s family, I have exhausted all possible means to stop the reckless actions of the Jiangxi CDI and the Yingtan Intermediate Court. Clearly, this case cannot currently be rectified in Jiangxi Province, and only the Supreme Court and the Central Commission for Discipline Inspection have the power to rectify it. I will not speculate on whether the Central Commission for Discipline Inspection has the motivation to rectify it. However, as the highest judicial authority, if the Supreme Court allows the fact that the People’s Courts have been completely marginalized and instrumentalized in the trial of official crimes to go unaddressed, the ultimate harm will not only be to the reputation of the court system. The consequences of allowing disciplinary power to go unchecked will endanger the safety and dignity of all 1.4 billion people in the country; no one will be able to enjoy safety and dignity alone.<\/p>\n\n\n\n

\u5f53\u7136\uff0c\u6700\u9ad8\u6cd5\u9662\u4e0d\u53bb\u505a\u5206\u5185\u4e4b\u4e8b\uff0c\u4e0d\u53bb\u7ef4\u62a4\u4e2d\u56fd\u5211\u4e8b\u5ba1\u5224\u7684\u4f53\u9762\uff0c\u6211\u4e5f\u4e0d\u76f8\u4fe1\u5730\u65b9\u7eaa\u59d4\u53ef\u4ee5\u957f\u671f\u4e3a\u6240\u6b32\u4e3a\u3002\u5f3a\u6881\u8005\u4e0d\u5f97\u5176\u6b7b\uff01\u4e2d\u56fd\u5386\u53f2\u4e0a\uff0c\u66fe\u7ecf\u4e0a\u6f14\u8fc7\u591a\u5c11\u6b21\u76f8\u4f3c\u7684\u4e00\u5e55\u3002\u4f46\u662f\uff0c\u8c01\u4eba\u53c8\u80fd\u6539\u53d8\u5386\u53f2\u7684\u65b9\u5411\uff1f\u76ee\u524d\u4e25\u91cd\u7834\u574f\u4e2d\u56fd\u6cd5\u6cbb\u7684\u9b51\u9b45\u9b4d\u9b49\uff0c\u4e0d\u4e45\u7684\u5c06\u6765\uff0c\u603b\u4f1a\u6709\u4eba\u6536\u62fe\u4ed6\u4eec\u3002\u53ea\u662f\uff0c\u5982\u679c\u6700\u9ad8\u5ba1\u5224\u673a\u5173\u5728\u8fd9\u4e2a\u8fc7\u7a0b\u4e2d\u65e0\u6240\u4f5c\u4e3a\uff0c\u53f2\u7b14\u5982\u94c1\uff0c\u4f60\u4eec\u8fd9\u4e9b\u7ba1\u4e8b\u7684\u4eba\uff0c\u5386\u53f2\u4e0d\u4f1a\u5bf9\u4f60\u4eec\u5bbd\u6055\uff01<\/p>\n\n\n\n

Of course, if the Supreme Court does not do its duty and fails to uphold the dignity of criminal trials in China, I do not believe that local CDIs can act with impunity for long. The bully does not meet their just end! How many similar scenes have been played out in Chinese history? But who can change the course of history? The demons currently severely damaging China’s rule of law will eventually be dealt with by someone. However, if the highest judicial body does nothing in this process, history, as unyielding as iron, will not forgive those in charge.<\/p>\n\n\n\n

\u6700\u540e\uff0c\u6211\u8fd8\u662f\u5e0c\u671b\u6700\u9ad8\u6cd5\u9662\u9886\u5bfc\u80fd\u591f\u4e3a\u5929\u4e0b\u82cd\u751f\u8ba1\uff0c\u4e3a\u81ea\u5df1\u7684\u524d\u9014\u8ba1\uff0c\u505a\u6b63\u786e\u7684\u4e8b\uff0c\u8d1f\u8d77\u5ba1\u5224\u673a\u5173\u7684\u6700\u540e\u628a\u5173\u4f5c\u7528\uff0c\u5236\u6b62\u5730\u65b9\u7eaa\u68c0\u6743\u529b\u7684\u8086\u65e0\u5fcc\u60ee\u3002\u4e0d\u7136\uff0c\u5929\u4e0b\u5c06\u88ab\u5176\u7978\uff0c\u800c\u543e\u83b7\u5148\u77e5\u4e4b\u540d\uff0c\u60b2\u592b!<\/p>\n\n\n\n

Lastly, I still hope that the leaders of the Supreme Court will consider the welfare of the people and their own futures, do the right thing, and fulfill the final safeguarding role of the judicial authorities to curb the unrestrained power of local disciplinary inspections. Otherwise, the world will suffer their calamity, and I, having foreseen this, will be known as a prophet, alas!<\/p>\n\n\n\n
